There have been calls for the authorities to take action against Langkawi MP Datuk Nawawi Ahmad, after he said the “Malaysian Official 1” (MO1) – mentioned by the US Department of Justice (DoJ) in its damning disclosures of thefts from 1MDB – referred to the Yang Di-Pertuan Agong.
But lawyer Syahredzan Johan said Nawawi’s statement was all about stupidity and did not warrant any action.
Nawawi in exchanges with his Facebook friends had said that going by the Malaysian Constitution, MO1 was actually referring to the Agong, and not Prime Minister Datuk Seri Najib Razak as widely speculated.
“According to the Federal Constitution, the country’s government was formed with three separate and independent entities which are the judiciary headed by the chief justice, the parliamentary body led by the Speaker, and the executive directed by the prime minister.
“Hence, in accordance to the Constitution, the Agong is the MO1,” said Nawawi, who not long courted controversy by saying that money from taxpayers belonged to the government and not the people.
However, his post had since been edited, with the last line saying: “All three entities are responsible to the Agong. Hence, Najib is not the MO1, as he is either MO2, MO3, or MO4.”
Nawawi’s earlier post however drew immediate fire, with Anina Saadudin, formerly with the Wanita wing at the Umno branch headed by Nawawi, lodging a police report.
“Umno claims to be fighting for the Malays and the royal institution. Yet, one of its leaders is making a statement insulting the institution, not a leader from say DAP, which they claim is a racist party,” she said.
Prominent lawyer Rosli Dahlan urged the police and attorney-general to charge Nawawi for insulting the royal institution, while former Kedah menteri besar Datuk Seri Mukhriz Mahathir demanded an apology.
However, Syahredzan said Nawawi could be giving his own interpretation of the Federal Constitution.
“He didn’t say the Agong was is ‘Malaysian Official 1’ as stated in the DOJ suit, but only gave his opinion based on the Federal Constitution.
“But his interpretation is too far-off because the Agong is not an ‘official’,” said Syahredzan as quoted by Free Malaysia Today.
On July 20, US investigators revealed that some US$3.5 billion was misappropriated from 1MDB, and named top Malaysian officials involved in the illegal syphoning of money out of the state fund.
The DOJ also named the stepson of Najib, Riza Aziz, for using more than RM250 million of 1MDB funds to finance the production of the movie “Wolf of Wall Street” starring Leonardo diCaprio.
Najib himself was not named, although the document merely cited “Malaysian Official 1”, mentioned 36 times in the 136-page document. – Malaysia Dateline
